1. Heard Mr. A. N. Bhakta and Mr. Vivek Bhakta, learned counsel for the petitioners as well as Mr. S.S. Baghel, learned Deputy Government Advocate, appearing for the State/respondent No.1. 2.
The present petition has been filed by the petitioners with the following prayers:
“1. allow this petition,
2. call for the entire records / case diary from the Police Station Janjgir, District Janjgir-Champa (C.G.),
3. quash the impugned First Information Report under Crime No. 0149/2025, registered on 02.03.2025 (ANN P-1), at police Station Janjgir, District Janjgir-Champa (C.G.), against the Petitioners for the offences punishable Under Sections 85, 296, 351 (2), 115(2) & 3(5) of the
3 Bharatiya Nyay Sanhita, 2023 {Corresponding Sections 498(A), 294, 506, 323 & 34 of the Indian Penal Code, 1860}, in the interest of justice. 4. quash the subsequent proceedings in pursuance to Crime No. 0149/2025, Dt. 02.03.2025, registered at P.S. Janjgir, District Janjgir-Champa (C.G.), in the interest of justice. 5. pass any appropriate order under the facts and circumstances of the case, as this Hon'ble Court may deems fit, in the interest of justice.”

It has been argued by the learned counsel for the petitioners that in pursuance of the order dated 28.04.2025 passed by this Court, parties have appeared before the Mediation Center of this Court on 09.06.2025, wherein all the disputes and differences between parties have been amicably settled by them, therefore, in view of the law laid down by the Apex Court in Manoj Sharma Vs. State and others , (2008) 16 SCC 1, B.S. Joshi Vs. State of Haryana & others, (2003) 4 SCC 675 and Gian Singh Vs. State of Punjab & another, (2012) 10 SCC 303, the impugned FIR and subsequent proceedings be quashed. 4. Learned State counsel could not dispute the aforesaid facts. 5. From perusal of the Compromise Deed dated 09.06.2025 arrived between the parties before the Mediation Centre of this Court, it transpires that both the parties, i.e. petitioners and respondent No.2, have mutually agreed to resolve their disputes amicably. 6.
Keeping in mind the ratio laid down by the Apex Court in Manoj Sharma (supra), B.S. Joshi (supra) and Gian Singh (supra) and
4 also taking into consideration that the dispute between the parties from which the impugned FIR has emanated has been amicably settled before the Mediation Centre of this Court, this Court is of the view that no useful purpose would be served in proceeding any further against the petitioners in this matter. 7. In that view of the matter, the instant petition is allowed and the impugned FIR bearing Crime No. 0149/2025, registered on 02.03.2025 (ANN P-1), at Police Station Janjgir, District Janjgir- Champa (C.G.), against the Petitioners for the offences punishable under Sections 85, 296, 351 (2), 115(2) & 3(5) of the Bharatiya Nyay Sanhita, 2023 (Corresponding Sections 498(A), 294, 506, 323 & 34 of the Indian Penal Code, 1860} and subsequent proceedings are hereby quashed.
