HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL APPEAL No. - 1473 of 2017 Court No. - 13 HON'BLE SAURABH LAVANIA, J. 1. On 29.10.2025, this Court had passed the following order:- "Seen the letter of the CJM, Lucknow dated 01.03.2025 as also the Office report based on the same. The basis of Letter and Office report aforesaid is the order dated 10.02.2025 passed by this Court whereby the C.J.M., Lucknow was directed to submit living status report of accused-appellant/Santosh Kumar. According to the Letter and Office report aforesaid, the correct information could not be ascertained on account of incomplete/insufficient address. This Court also considered the death certificate of accused-appellant/Santosh Kumar, (annexed as Annexure No. 3 to the affidavit of surety namely Prem Kumar filed in support of application for discharge), according to which, accused-appellant/Santosh Kumar, expired on 08.12.2018. The death certificate of accused-appellant/Santosh Kumar also indicates place of death i.e. House No. 569 Ka/253 Sneh Nagar, Alambagh, Lucknow, U.P. In the aforesaid background of the case, the C.J.M., Lucknow is directed to submit afresh report by the next date fixed. List/put up this case on 10.11.2025. Office is directed to communicate this order to the C.J.M. concerned." 2. In compliance of above quoted order, Chief Judicial Magistrate, Lucknow sent report/letter dated 07.11.2025 to this Court, as per which, sole appellant/Santosh Kumar has died on 08.12.2018. Death certificate of the sole appellant has also been placed on record. 3. In view of aforesaid, the instant appeal is dismissed as abated. Sureties are discharged.
