(ORDER) 26.08.2025 Learned counsel for the election petitioner, Mr. BR Sharma and learned counsel for respondent No. 1, Mr. A. Mohendro are present before the Court physically. The connected proceeding in MC (EL. PET.) No. 19 of 2025 has been filed by the applicant/respondent No. 1 in EL. PET. No. 7 of 2022 keeping in view the provision of Order 16 sub Rule 2 of Rule 1, Rule 6 and 7 of the CPC read with Section 87 of the Representation of People Act, 1951, praying for summoning Seema Shukla, Public Information Officer, Office of the Director, Uttar Pradesh Institute of Textile Technology, for giving evidence and to produce the relevant documents before the Commissioner. The applicant had presented list of witnesses on his behalf before the Hon’ble Court on 25.01.2025, but the proposed witness in this application is not in the list of witnesses dated 25.01.2025. the application, it is indicated that the proposed witness is an important witness and her evidence is very much necessary in determining the issue of the above referred Election Petition. On these premises, the applicant is seeking for consideration of the grounds which are being urged in this application, seeking for summoning the witness for giving evidence and to produce the documents to adduce evidence. Therefore, keeping in view the submission which is made by the learned counsel for the applicant/respondent No. 1, Mr. A. Mohendro and so also the submission which is made by the learned counsel for the election petitioner/respondent herein, Mr. BR Sharma are concerned, it is deemed appropriate that this miscellaneous application proceeding is hereby allowed in the interest of justice. Accordingly, MC (EL. PET.) No. 19 of 2025 is hereby disposed of. Registry is directed to list the remaining proceedings in EL. PET. No. 7 of 2022, EL. Recr. Pet. No. 5 of 2022 and MC (EL. PET.) No. 9 of 2025 on 26.09.2025.
