ORDER:
1. The learned counsel for the petitioner submits that a major punishment of withholding four annual grade increments with cumulative effect was imposed on the petitioner, as ten out of the eleven charges alleged against him were held to be proved. 2.
The learned counsel for the petitioner submits that the said order of punishment is dated 19.08.2024. The learned counsel further submits that the petitioner preferred an appeal before the appellate authority on
16.10.2024. It is also submitted that, on 03.01.2025, the said appeal was referred to the 2nd respondent for examination on merits. However, no further orders have been passed, nor has any date been fixed for hearing of the appeal. Aggrieved thereby, the present writ petition was filed on 18.11.2025, and no counter has been filed. 3. The learned counsel for the petitioner submits that the petitioner is restricting the relief sought in the writ petition and seeks a direction to the respondents to dispose of the appeal on its own merits. It is further submitted by the learned counsel for the petitioner that the petitioner is anticipating promotion and that the respondents may cite the punishment imposed upon him and the pendency of the appeal as grounds to overlook the petitioner’s seniority. 4. Considering the same, the writ petition is disposed off with a direction to the respondents concerned to consider the appeal filed by the petitioner and dispose of the same within a period of three months from the date of receipt of copy of this order. The respondents shall also consider the case of the petitioner for promotion on par with others, subject to the outcome of the appeal. 5. With the above observations, the writ petition is disposed off. There shall be no order as to costs.
