HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11264 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J. 1. Heard Sri Dhirendra Kr. Agnihotri, the learned counsel for the petitioner and Sri Rahul Shukla, the learned Additional Chief Standing Counsel for the State of U.P. 2. By means of the instant writ petition, the petitioner has challenged validity of a communication dated 29.10.2025 sent by the Public Information Officer, Madhyamik Shiksha Parishad to the petitioner in furtherance of his representation dated 26.09.2025. 3. In the representation dated 26.09.2025, the petitioner had stated that he had applied for scrutiny of marks of his intermediate examination year 2025 but as he was not satisfied with the outcome, he requested for his answer books of subjects General Hindi, English, Physics, Chemistry and Arithmetic to be shown to him. The petitioner mentioned his roll number in his representation as 225511064. 4. In the communication dated 29.10.2025 it is written that the representation does not mention the roll number of the petitioner and, therefore, difficulty was faced in collecting information regarding him. The communication further states that the answer books of intermediate examination for the year 2025 has been weeded out on 28.07.2025 and, therefore, showing the answer sheets is not possible. Versus Counsel for Petitioner(s) : Dheerendra Kr. Agnihotri, Pankaj Kumar Shukla Counsel for Respondent(s) : C.S.C. Nirbhay Patel Minor Under The Guardinship Of His Father Ram Nath .....Petitioner(s) State Of U.P. Thru. Thru. Prin. Secy. Deptt. Of Secondary Edu. Lko. And 4 Others .....Respondent(s) 5. The learned counsel for the petitioner submitted that the petitioner had mentioned the roll number in the representation. He further submitted that there is no policy regarding weeding out of answer books. 6. In respect of the aforesaid submissions, the learned Additional Chief Standing Counsel has submitted that marksheet-cum-certificate of the petitioner mentions his roll no. as 2255919064 whereas in the representation dated 26.09.2025 he has mentioned his roll no. 0225511064. As the petitioner mentioned a wrong roll number and he did not mention his roll number in his representation, it is rightly mentioned in the communication dated 29.10.2025 that difficulty was faced in collecting the information regarding the petitioner. 7. Regarding the policy for weeding out answer sheets, it has been informed in the written instructions provided to the learned Standing Counsel that a government order date 12.07.1937 provides that answer sheets or answer books shall be maintained only till completion of scrutiny and thereafter those can be weeded out. 8. In the present case, result of scrutiny was communicated on 07.07.2025 and the answer books have been weeded out three weeks thereafter i.e. on 28.07.2025. 9. In view of the aforesaid facts and circumstances of the case, now the relief of showing answer books cannot be granted to the petitioner as the said relief has become impossible. 10.
