Order 07/05/2025
1. This instant writ petition filed by the petitioner with a limited prayer to direct the respondents to make payment of his due salary w.e.f. 09.03.2015 along with interest.
2. At the outset, learned counsel for the respondent has informed the Court that the petitioner was engaged as Assistant Radiographer through the placement agency. It has also been informed that so far as salary of the petitioner from 20.03.2015 till January 2016 is concerned, the same has already been paid to the petitioner.
[2025:RJ-JP:19306] (2 of 2) [CW-18081/2015]
3.
Learned counsel for the petitioner has not disputed this fact, however, has submitted that the due salary subsequent thereto has not yet been received by him.
4.
Learned counsel for the respondents has put forward an excuse that on account of lack of budget salary for the remaining period could not be paid to the petitioner. Such excuse extended by the respondent is totally lame and unjustified.
5. This Court cannot accept the contention raised by the respondents that the respondents do not have budget for making payment of salary of an employee appointed on contract basis. Such reasons have been put forward only with a view to defeat legitimate right of the petitioner.
6. In the light of above, the writ petition is partly allowed and the respondents are directed to make payment of due salary, if any, to the petitioner from January, 2016 either themselves or through their authorized placement agency within a period of two months from the date of receipt of certified copy of this order, failing which, the due salary shall carry interest @ 6% per annum.
7. Accordingly, the writ petition stands disposed of as aforesaid.
8. Stay application and all pending application(s), if any, also stand disposed of.
