Accused in Crime No.527/2024 registered by Challakere Police Station, Chitradurga District, for the offences punishable under Sections 115(2), 118(1), 118(2), 352 and 109(1) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.527/2024 was registered by Challakere Police Station, Chitradurga District, for the aforesaid offences based on the first information dated 13.11.2024 received from Ravi S/o late Veeranna. During the course of investigation, petitioner herein was arrested on 14.11.2024 and remanded to judicial custody. His bail application filed before the - 3 - NC: 2025:KHC:10054 CRL.P No. 2728 of 2025 jurisdictional Sessions Court in Crl.Misc.No.113/2025 was rejected on 01.02.2025. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that in the incident in question that had taken place on 13.11.2024, even the petitioner was injured. There is a case and counter case registered by the very same police station. Injured victims in the present case have been discharged from the Hospital. Petitioner has no other criminal antecedents. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition however, he does not dispute the submission made by learned counsel for the petitioner. 6. In respect of the incident that had taken place on 13.11.2024, there is a case and counter case registered by the very same police station. A perusal of the first information itself would go to show that petitioner was also found injured on his right leg. Allegation against the petitioner in the present case is that since the injured victims had refused to give money to him to consume alcohol, he had abused and assaulted them. Undisputedly, petitioner has no other criminal antecedents. In - 4 - NC: 2025:KHC:10054 CRL.P No. 2728 of 2025 the incident in question that had taken place on 13.11.2024, petitioner as well as three victims in the present case had suffered injuries. Except Srinivasa, two other victims in the present case have suffered only simple injuries. Srinivasa, who had suffered grievous injuries has been discharged from the Hospital and his condition is said to be stable. Investigation in the case is completed and charge sheet has been filed. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.527/2024 registered by Challakere Police Station, Chitradurga District, for the offences punishable under Sections 115(2), 118(1), 118(2), 352 and 109(1) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the - 5 - NC: 2025:KHC:10054 CRL.P No. 2728 of 2025 Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
