Lahkar, learned Addl. Public Prosecutor, Assam for the State respondent. This application has been preferred by the petitioner namely, Moustak Ahmed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, Page No.# 2/2 praying for pre-arrest bail, apprehending arrest in connection with Lumding P.S. Case No. 82/2025 under Section 70(1) of BNS, 2023. Perused the case diary. As per FIR lodged by the victim, the victim was subjected to sexual relationship by the petitioner. It appears that pursuant to the order of the interim pre-arrest bail dated 27.08.2025, the petitioner has appeared before the Investigating Officer and his statement was recorded. Having regard to the nature of the allegation made in the FIR custodial interrogation of the petitioner may not be necessary. Accordingly, prayer for pre- arrest bail is allowed. The interim order dated 27.08.2025 is hereby made absolute subject to the conditions made in the interim order itself. With the above directions, this bail application stands disposed of.
