Heard Shri Saud Khan, Advocate holding brief of Shri Mohd. Wajid Khan, learned counsel for petitioner in Writ Petition No. 6323 of 2025 and Shri Saud Khan, learned counsel for petitioner in Writ Petition No. 6314 of 2025, learned Standing Counsel for the State and perused the material available on record. 2. By means of the present petition having number MATTERS UNDER ARTICLE 227 No. - 6323 of 2025, the petitioner has prayed the following prayer:- "to issue a writ, order or direction in the nature of Mandamus directing the learned Civil Judge, (Junior Division) Haweli, Ayodhya to decide O.S. No. 26 of 2022 (Kumaresh Dubey Vs. Bhanu Pratap) filed by petitioner/plaintiff for specific performance of contract, pending before him within the stipulated period of time." 3. In petition having number MATTERS UNDER ARTICLE 227 No. - 6314 of 2025, Versus Counsel for Petitioner(s) : Mohd Wajid Irfan, Al Saud Khan Counsel for Respondent(s) : Versus Counsel for Petitioner(s) : Al Saud Khan Counsel for Respondent(s) : Kumaresh Dubey @ Kumaresh Doobe .....Petitioner(s) Pratap Bhanu .....Respondent(s) Kumaresh Dubey @ Kumaresh Doobe .....Petitioner(s) Pratap Bhanu .....Respondent(s) the petitioner has prayed following prayer:- "to issue a writ, order or direction in the nature of Mandamus directing the learned Civil Judge (Junior Division), Haweli, Ayodhya to decide O.S. No. 1270 of 2021 (Bhanu Pratap Vs. Kumaresh Dubey) filed by opposite party/plaintiff for cancellation of sale agreement, pending before him within a stipulated period of time." 4. Submission of learned counsel for petitioner is that a suit for specific performance of contract having O.S No. 26 of 2022 (Kumaresh Dubey Vs. Bhanu Pratap) was filed in the court of learned Civil Judge (Junior Division), Haweli, Ayodhya. It is further submitted that the said case is fixed for framing of issues. It has also been brought to the notice of the Court that the opposite parties in the aforesaid suit have also filed a Suit for Cancellation of sale agreement having O.S. No. 1270 of 2021 (Bhanu Pratap Vs. Kumaresh Debey), which is also pending before the same court for adjudication, wherein the issues have already been framed. 5. Learned counsel for petitioner has submitted that the opposite parties in O.S. No. 26 of 2022 are playing delaying tactics, causing great hardship to the petitioner. 6. In view of the proposed order being passed, notice to private opposite parties are dispensed with. 7. Looking to the aforesaid circumstances, this Court is of the considered opinion that no useful purpose would be served in keeping the petition as mentioned here-in-above pending, as such, the same are being disposed of at the admission stage itself. 8. Accordingly, both the aforesaid writ petition are being disposed of with a direction to the learned Civil Judge, (Junior Division) Haweli, Ayodhya to decide O.S. No. 26 of 2022 (Kumaresh Dubey Vs. Bhanu Pratap) as well as O.S. No. 1270 of 2021 (Bhanu Pratap Vs. Kumaresh Debey), as expeditiously as possible, preferably within a period of one year from the date a certified copy of this order is produced before it after affording due opportunity of hearing to the parties concerned strictly in accordance with law. 9.
