HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10567 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J. 1. Heard Shri Anil Mishra, the learned counsel for the petitioner and Shri Devendra Mohan Shukla, the learned Additional Chief Standing Counsel for the State of U.P. 2. By means of the instant writ petition filed under Article 226 of the Constitution of India, the petitioner has challenged the validity of an order dated 18.11.2021 passed by the respondent No.2- District Magistrate/Collector, Gonda in Misc. Application No.36/Reder/2021-22 for rejecting the petitioner's representation under Section 95 of Uttar Pradesh Panchayati Raj Act, 1947. 3. There is no averment in the entire petition explaining the delay of almost four years in filing this writ petition. 4. The learned counsel for the petitioner has orally submitted that the delay has occurred because the petitioner is a poor villager and he was busy in agricultural activities. However, in the petition filed under Section 95(5) of Uttar Pradesh Panchayati Raj Act, 1947, the petitioner has stated that he is a vigilant and active citizen and is a social worker and the conduct of the petitioner in filing a writ petition challenging the order dated 18.11.2021 with a delay of four years, without any explanation for the delay when he claims himself to be a vigilant and active social worker, indicates that the petition suffers from unexplained latches. 5. Accordingly, the petition is dismissed on the ground of latches. (Subhash Vidyarthi,J.)
