HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12148 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
2. The applicant seeks enlargement on bail in FIR No.2 of 2025, under Sections 103(1), 3(5), 238 of BNS, Police Station Jethwara, District Pratapgarh.
3. It is argued by the Counsel for the applicant that on the same allegation and evidence, the co-accused Prince Patel has been enlarged on bail by this Court vide order dated 14.11.2025 passed in Criminal Misc. Bail Application No.7579 of 2025.
4. Learned A.G.A. vehemently opposed the bail prayer.
5. Considering and adopting the same reasoning as contained in paras 3 and 5 of the order dated 14.11.2025 and the fact that the allegation against the applicant to be similar to the co-accused, who has already been enlarged on bail coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 14.01.2025, I am of the view that the applicant is entitled to be released on bail on the ground of parity. Accordingly, the bail application is allowed.
