1. Present petition has been filed by the petitioner seeking issuance of directions to the respondents to take necessary action for registration of FIR or in alternative to transfer the investigation of the said complaint to some higher police officials. 2. On 29.01.2025, following order was passed:
“ Present petition has been filed by the petitioner seeking direction to the respondents to take necessary action for registration of the FIR or in alternative to transfer the investigation in the said complaint to some higher police officials. List again on 17.02.2025. In the meanwhile, facts of the present case would be verified from the members of the Bar Association, Sonepat, including its President and Secretary, and thereupon, respondent No.2 - DGP, Haryana, would file his status report in the matter, before the next date of hearing.”
3. On 17.02.2025, following order was passed”
“An affidavit dated 14.02.2025 of Director General of Police, Haryana, Panchkula, filed today in the Court, is RASHMI 2025.05.01 09:27 I attest to the accuracy and integrity of this document
CRM-M-4860-2025 2 taken on record. Copy thereof has already been handed over to the counsel for the petitioner. As per the affidavit, FIR No.32 dated 06.02.2025, under Sections 125, 194, 281, 324(2) BNS, has already been registered at Police Station City, Sonipat and for non-registration of FIR despite there being recording of DDE No. 13 dated 20.01.2025, under Section 324(2) BNS, regular departmental inquiry has also been initiated against SI Mukesh, Incharge, Police Post Court Complex, Sonipat and ASI Sunil, posted in the said police post. To have an update regarding steps taken by the prosecution agency, in pursuance to the registration of the FIR and initiation of the departmental proceedings against the erring officials, adjourned to 13.03.2025.”
4. On 17.03.2025, following order was passed:
“ Learned State counsel has filed status report by way of an affidavit of Rahul Dev, HPS, Assistant Commissioner of Police, City Sonipat on behalf of respondents No. 1 and 2/State in the Court today. Same is taken on record.
A copy thereof has been handed over to learned counsel for the petitioner. Registry is directed to tag the same at appropriate place with the paper-book. Paragraph No.8 of status report, says as under:
“8. The said case is still under investigation and deponent assures the Hon'ble High Court that investigation of said case shall be met to its logical end by conducting a thorough, fair and meticulous investigation. No person shall be benefited or prejudiced in any manner and investigation of the said case shall be concluded in accordance with law on the basis of available evidence. Two of the accused persons namely Shyam Sunder and Kuldeep Singh have already been joined in the investigation of present case, but challan against them is yet to be submitted before the learned Court RASHMI 2025.05.01 09:27 I attest to the accuracy and integrity of this document
CRM-M-4860-2025 3 and one accused namely Mukesh has not joined the investigation, for which notice has been issued to him for 20.03.2025. It is further submitted that after receipt of permission under PPR-16.38 from the Deputy Commissioner, Sonipat, the departmental enquiry against the above named officials of Police Post Court Complex, Sonipat shall also be concluded expeditiously in accordance with law.” To await the outcome, adjourned to 30.04.2025.”

Today, on instructions from SI Rohit, learned State counsel informs that after completion of investigation, final report under Section 193 of BNSS (Section 173 Cr.P.C.) has already been submitted to the Court of concerned Area Magistrate, therefore, no further directions are required to be issued in the present case. 6.
