ORDER Date : 09.04.2025 Heard Mr. A.R. Agarwala, learned counsel for the applicants and Mr. S. Pegu,
learned counsel for the respondent/opposite party. This interlocutory application is preferred by the applicants, for allowing them to withdraw a sum of Rs. 5,59,000/- deposited by the opposite party before the Registry of this Court, pursuant to the order of this Court dated 08.04.2024, in I.A. (Civil) No. 1079/2024, corresponding to MACApp No. 151/2024. Mr. Agarwala, learned counsel for the applicants submits that pursuant to the order of this Court dated 08.04.2024, the opposite party i.e. National Insurance Co. Ltd. had deposited a sum of Rs. 5,59,000/- before the Registry of this Court and the applicants may be allowed to withdraw the said amount. Mr. Pegu, learned counsel for the respondent/opposite party submits that since appeal has already been preferred for violation of policy condition, the amount may be released subject however to furnish an indemnity bond by the applicants. Taking note of the submission of learned counsel for both the parties, this I.A.(Civil) No.2813/2024, stands allow by permitting the applicants to withdraw the amount of Rs. 5,59,000/- before the Registry of this Court. Subject however to furnishing an indemnity bond of equal amount.
