Heard learned counsel for the petitioner and learned Standing Counsel for the State Respondents. 2. This writ petition has been filed with the following main prayer:- "(i) Issue a writ order or direction in the nature of the MANDAMUS, thereby commanding the opp. Party no.1 & 2 to decide the representations dated 27-10-2025 of the petitioner, as contained in Annexure no.1, to this writ petition, with in some stipulated time, which is fixed by this Hon'ble Court, in the interest of justice." 3. It has been submitted by learned counsel for the petitioner that the land in dispute, i.e. Gata Nos. 38, 42, 47, 48, 89, 94, 123, 134(Ka), 135, 142(kha) and 182(Min.), is recorded as surplus land in the Revenue Land in the current Khatauni 1428-1433 fasli in Village Metehi, Block Mihipurwa, Pargana Dharmapur, Tahsil- Mihipurwa at Motipur, District Bahraich, but the opposite parties no.5, 6 and 7 have taken over such land, they are Bhumafia and the petitioner has approached the District Magistrate, Bahraich on 27.10.2025 by filing representation, which has not been decided. 4. This writ petition is disposed of with liberty to the petitioner to approach the Police Station concerned by lodging F.I.R., if the Versus Counsel for Petitioner(s) : Ram Pheran Dwivedi, Subhash Kumar Verma, Vineeta Dwivedi Counsel for Respondent(s) : C.S.C. Tyagi Baba @ Tyagi .....Petitioner(s) Commissioner Devi Patan Mandal Gonda And 6 Others .....Respondent(s) Respondents No. 5, 6 and 7 are encroachers/Bhumafias.
