HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6171 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J. Heard Ms. Nisha Verma, learned counsel for the petitioner as well as learned Standing counsel on behalf of respondent No.1. 1. In light of the proposed order notice to private respondents is dispensed with. 2. By means of the present petition the petitioner has prayed for stay of the proceedings under Section 34 of U.P. Revenue Code in case No.T201704710102754 (Rajkumar Vs. Shayara Bano) and case No.1664 (Rajkumar Vs. Avadh Naresh) in respect of gata No.306 (Ka) situated at Village Tikariya, Pargana Amethi, Tehsil Gauriganj, District Amethi. 3. It has been submitted that the said proceedings were initiated by opposite party No.s 3 and 4 and the petitioner is an opposite party in the said case and has filed her objections and the said proceedings which are pending consideration. It is during pendency of the aforesaid proceedings that the petitioner has moved a transfer application before the Board of Revenue which has been numbered as Transfer Application No.2901/2025. 4. Considering the fact that the transfer application is already pending consideration before the Board of Revenue and any interim relief can be sought for by the petitioner before the Board of Revenue where the transfer application is pending as, such, for the relief prayed for in this petition, this Court would not entertain fresh writ petition considering that the grievance of the petitioner can be remedied by the Board of Revenue where the transfer application is pending. 5. Apart from the above, we find that though the petitioner has not given the details but he had earlier obtained the order of this Court for expediting the proceedings which is evident from the perusal of the order dated 8.9.2025 where 6. Versus Counsel for Petitioner(s) : Nisha Verma, Azmi Yousuf Counsel for Respondent(s) : C.S.C. Kaushal Kumar .....Petitioner(s) State Of U.P. Thru.
