This writ petition has been filed with the following prayer :- Issue, a writ, order or direction in the nature of Mandamus commanding/directing the opposite parties No.2 and 3 to get removed the encroachment of pillar and fencing wire from the land of petitioner Gata No.940 area 0.070 hectare situated in village & Post Magarsan Kala, Tehsil Kadipur, District Sultanpur, which has been encroached by the opposite party No.4 illegally without any authority of law. The matter has been taken in the revised call. Learned counsel for the petitioner is not present. Learned counsel for the respondent is present and has placed before this Court the judgment and order dated 16.09.2025 passed in Writ C No. 9090 of 2025, Kusum vs. State of U.P. through the District Magistrate, Sultanpur and Others. It has been submitted that the petitioner is the same person and the cause of action is also the same, relating to Gata No. 940 situated in Village & Post Magarsan Kala, Tehsil Kadipur, District Sultanpur. There is no mention in the present writ petition of an earlier writ petition having been filed by the petitioner, namely Writ C No. 9090 of 2025, which was disposed of by this Court on 16.09.2025.
