This petition under Section 482 BNSS is filed by the petitioner, namely, Rupam Kumar Sarkar, apprehending arrest in connection with Abhayapuri P.S. Case No. 216/2024 registered u/s 316(2)/318(2) BNS, read with Section 21(1)/21(2)/21(3) of Banning of Unregulated Deposit Scheme Act, 2019 (NG. R Page No.# 2/2 No. 344/2024). 3. The ejahar dated 06.09.2024 names four persons who are stated to be leading the activity of misappropriation of cores of rupees through illegal apps namely, Hedgex. 4. The learned counsel for the petitioner submits that pursuant to the order dated 21.08.2025, the petitioner appeared before the investigating officer and recorded his statement. It is also submitted that several co-accused have already been granted bail. 5. Mr. Borthakur, learned Additional Public Prosecutor submits that the investigation has revealed some incriminating materials against the present petitioner. 6. Perused the statements of the witnesses as annexed in this regard. Considering the cooperation rendered by the petitioner as well as progress of investigation – the interim protection granted vide dated 21.08.2025 is hereby made absolute subject to the conditions – that the petitioner shall cooperate with the remaining investigation and shall be available for trial if one commences; and that the petitioner shall not hamper or tamper with evidence. 7. Violation or breach of condition(s) shall entail cancellation of the bail. 8. The petition stands disposed of accordingly. 9. Send back the case diary. JUDGE Comparing Assistant
