By way of filing this writ petition, a prayer has been made for issuing directions to the Rent Tribunal, Jaipur Metropolitan II to decide the eviction application No.343/2023 filed by the petitioner under Section 9 of the Rajasthan Rent Control Act, 2001 (hereinafter referred to as “the Act of 2001”) within a time frame. 2. Learned counsel for the petitioner submits that the aforesaid application was submitted by the petitioner in the year 2023 and inspite of passing of considerable time till date the said application has not been decided, so appropriate directions be issued to the Tribunal to decide the said application within a time frame. 3. Heard and considered the submissions made at the Bar and perused the material available on the record. [2025:RJ-JP:21438] (2 of 2) [CW-7464/2025] 4. Perusal of the record indicates that the eviction application has been preferred by the petitioner against the respondent under Section 9 of the Act of 2001 in the year 2023 wherein reply to the application has been submitted on 06.01.2024 and, thereafter, issues have been framed on 05.03.2024 and the case has been posted for recording the evidence of the applicant. 5. The Hon’ble Apex Court in the case of High Court Bar Association, Allahabad vs. State of Uttar Pradesh, while deciding Criminal Appeal No.3589/2023 has deprecated the practice of the constitutional Courts for issuing directions to the subordinate Courts to decide the matter in a time span. 6. In the instant case, hardly two years have passed and the petitioner has approached this Court seeking aforesaid directions. 7. The aforesaid directions cannot be issued by this Court. But looking to the fact that pleadings are complete and issues have been framed, it is expected from the Rent Tribunal to make all possible endeavours to decide the eviction application expeditiously as early as possible. 8. With the aforesaid observations/directions, the instant writ petition stands disposed of. Pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J Karan/32
