Tiwari, A.P.P. 05/ 01.09.2025: Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Satgawan P.S. Case No. 91/2024, registered under sections 274, 275/3(5) of B.N.s, 2023 and section 47(a) of Excise Act, pending in the Court of learned Judicial Magistrate, Ist Class, Koderma. 3. Learned counsel for the petitioner submits that two of the co- accused persons have been granted anticipatory bail in A.B.A. No. 393/2025. He submits that alleged mahua liquor has been recovered from the forest area and notice under section 35(3) of BNSS, 2023 has been received by the petitioner. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that illegally mahua liquor was being prepared. 5. In view of above and considering that two of the co-accused persons have been granted anticipatory bail in the aforesaid A.B.As and petitioner has received the notice under Section 35(3) of BNSS, 2023 the petitioner is directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned ( 2025:JHHC:26370 ) court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
