This matter is taken up as unlisted item in supplementary-2 due to urgency involved in the matter. [2]
Heard Mr. N. Jotendro, learned senior counsel assisted by Mr. Syed Murtaza Ahmed, learned counsel for the petitioners and Mr. H. Debendra, learned Dy. A.G. assisted by Ms. Sharmila, learned Jr. G.A. for the State respondent. [3]
The petitioners approached this Court for restraining the respondent from evicting the petitioners from their respective land under village No. 33-Khurai Angom Leikai, Imphal East in pursuance to appeal/notice dated 20.07.2025 and letter dated 22.08.2025. [3]
The petitioners have submitted an application dated 21.08.2025 for considering allotment of land under eviction and the same is pending with the Deputy Commissioner, Imphal East. [4]
Mr. H. Debendra, learned Dy. A.G., submits that the application for allotment has been submitted only few days back after the issuance of the eviction notice. [5]
Mr. N. Jotendro, learned senior counsel for the petitioners, submits that he may be given some time to shift the
structure from the encroached area and at the same time, he may be given some time to get the allotment in hand. [6]
Mr. H. Debendra, learned A.G., has no objection in granting some reasonable time to the petitioners to remove the encroached structure and it is for him to wait the outcome of the allotment order. [7]
Recording the submissions made at the bar, writ petition is disposed of by granting 20 days time to the petitioners to remove the structure from the encroached area. By doing so, the right of the petitioners to be considered for allotment should not be affected. [8]
With this observation, writ petition is disposed of. Misc. application is closed. [9]
