Advocate (HON’BLE SHRI JUSTICE BIBHU DATTA GURU) Order on Board 30/04/2025 1. By the present writ petition, the petitioner, who is presently working on the post of Demonstrator in Govt. Medical College, Raigarh, is seeking a direction towards the respondent authorities for payment of salary since 16/08/2024 and further seeking direction to consider and decide his representation pending before the authorities. 2. Learned counsel appearing for the petitioner would submit that initially the petitioner was appointed as Demonstrator in Shri Baliram Kashyap Government Medical College, Jagdalpur vide appointment order dated 01/02/2017, thereafter, vide order dated 13/03/2024, he was posted at Government Medical College, Raigarh, however after joining at Raigarh College, no salary is being paid to the petitioner since the month of August, 2024 that too withholding the salary of the petitioner without assigning any reasons. He further submits that the petitioner submitted a representation dated 18/03/2025 (Annexure P/1) before the Respondent No.2, however, the same has not been considered till date. 3 / 3 3. Learned counsel appearing for the State would submit that if the representation submitted by the petitioner is still pending before the respondent authorities, the same shall be considered in accordance with law and necessary decision will be taken within the stipulated time. 4. I have heard learned counsel for the parties and perused the documents as well as the pleadings made by the petitioner. 5. In view of the aforesaid submission made by the counsel for the State and looking to the fact that the petitioner has already submitted a representation before the respondent No.2 raising his grievance regarding non-payment of salary since August, 2024, which has not been decided till date, the concerned authorities/ respondent No.2 is directed to consider the representation of the petitioner and take appropriate decision in accordance with law, within a further period of 45 days from the date of receipt of a copy of this Order. 6.
