Heard Sri. Mohan Kumar H.G., learned counsel appearing for the petitioner, learned counsel, Smt. Megha Shashikanth along with the learned CGC, Sri. M. Unnikrishnan, - 3 - NC: 2025:KHC:9522 WP No. 5863 of 2025 appearing for respondent Nos.1 and 2, Sri. Mohammed Jaffer, learned AGA appearing for respondent Nos.3 and 4 and have perused the material on record. 3. Facts in brief, germane, are as follows: The petitioner is the holder of a Indian Passport, which was valid upto 23.08.2021. The petitioner gets embroiled in a crime in Crime No.105/2016 for certain offences. The police, after investigation, have filed a 'B' report before the concerned Court way back in the year 2021. It transpires that no order is passed on the 'B' report owing to the fact that the complainant who has filed protest petition is not appearing before the Court. In that light, the concerned Court has not taken the 'B' report to its logical conclusion. The passport of the petitioner has expired and is wanting re-issuance of the said passport. 4. Learned counsel representing No.1 - Union of India and respondent No.2 would submit that the application so filed by the petitioner has been closed on account of the pendency of the criminal case. - 4 - NC: 2025:KHC:9522 WP No. 5863 of 2025 5. In the light of the afore-narrated facts, I deem it appropriate to direct the petitioner to submit a fresh application seeking re-issuance of the passport and respondent No.2 shall consider the same and issue necessary passport in accordance with law, as expeditiously as possible, as and when it is filed. 6.
