HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7758 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that, acting on information received from an informer, the police apprehended the applicant and allegedly recovered a 12-bore pump-action gun, 100 live cartridges of .32 bore, 160 live cartridges of .315 bore, along with a forged and fabricated Aadhaar card and a gun licence purportedly issued in the name of Praveen Kumar, son of Anil Kumar. Learned counsel for the applicant submits that the applicant's implication rests solely on the confessional statement of co-accused Ankit Kumar Chauhan @ Krishna Thakur, who has already been granted bail. It is further contended that no recovery has been effected from the applicant's possession, thereby placing his case on a better footing than that of the bailed co-accused. Counsel for the applicant further submits that the applicant has explained his criminal history of three cases within the bail application. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the Versus Counsel for Applicant(s) : Shivam Srivastava, Akshat Srivastava Counsel for Opposite Party(s) : G.A. Accordingly, the bail application is allowed.

In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (v) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him in accordance with law.
