Heard learned counsel for the petitioner, Dr. Uday Veer Singh, learned counsel for respondent nos. 3 & 4, Mr. P.K. Singh, learned Additional Chief Standing Counsel for the State and perused the record. Instant writ petition has been filed with the following prayers:- "i. Issue a writ, order or direction in the nature of Certiorari quashing the order dated 12.11.2025 passed by respondent no.3 (Annexure No. 1). ii. Issue a writ, order or direction in the nature of mandamus commanding to the respondent no. 3 to grant maternity leave to the petitioner from 11.11.2025 to 09.05.2025 with full salary and other emoluments. iii. Issue any other writ order or direction which this Hon'ble Court may deem fit and proper under the circumstances of the case. iv. Award the cost to the petitioner." From perusal of the impugned order, it is apparent that the reasons has not been assigned while rejecting the claim of the petitioner for the maternity leave, which is impermissible under the law. In this view of the matter, the order impugned dated 12.11.2025 is hereby quashed. The Matter is remitted back to the District Basic Education Officer concerned to pass a fresh order on the claim of the petitioner for maternity leave, within period of four weeks while associating the petitioner with the Versus Counsel for Petitioner(s) : Ashok Kumar, Chandra Prakash Counsel for Respondent(s) : C.S.C. Neha Shukla .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Basic Edu., Lucknow And 3 Others .....Respondent(s) hearing. With the aforesaid observation, the instant petition is disposed of.
