DEVINDER SINGH Versus SIDDHARTHA ACHARYA CMP-14117 of 2025 in COPC-584 of 2025 24.06.2025 Present: Mr. Subhash Mohan Snehi, Advocate, for the applicant/petitioner. Mr. Ramesh Chand Sharma, Advocate, for the respondents. By way of instant application, prayer has been made on behalf of applicant/petitioner for revival of COPC No.584 of 2025, titled as Devinder Singh Vs. Siddhartha Acharya, which was disposed of on 16.06.2025 on the undertaking given by learned counsel representing the respondents that needful, in terms of judgment/order dated 04.06.2025 passed by this Court in Devinder Singh Vs. Dr. YSPUHF and Another, shall be done expeditiously. Since needful in terms of judgment, taken note hereinabove, was not done, petitioner has approached this Court through the instant application. 2. While putting in appearance on behalf of non- applicants/respondents, Mr. Ramesh Chand Sharma, Advocate, on instructions, states that repeatedly petitioner has been called to put in appearance on behalf of the respondents, but on one pretext or the other, he does not come, as a result thereof, needful, otherwise required to be done in terms of judgment/order dated 04.06.2025 passed by this Court, could not be done. He further states that applicant/petitioner has been purposely evading his presence before the competent authority and thereafter, just to falsely implicate the respondents in contempt proceedings, has approached this Court in the present case and as such, exemplary cost is required to be imposed. 3. Though aforesaid submission made by learned counsel representing the non-applicants/respondents has been seriously refuted by Mr. Subhash Mohan Snehi, learned counsel representing the applicant/petitioner, but having taken note of the fact that despite there being repeated opportunities, applicant/petitioner herein is not presenting himself before the competent authority, enabling them to do the needful in terms of judgment/order dated 04.06.2025 passed by this Court, there appears to be no justification for this Court to entertain the present application and accordingly the same is dismissed. Applicant/petitioner is directed to make himself present before the competent authority on 03.07.2025, enabling respondents to do the needful in terms of judgment, alleged to have been violated, failing which, respondents would be at liberty to take appropriate action against the applicant/petitioner, in accordance with law.
