HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14586 of 2025 Court No. - 18 HON'BLE SHREE PRAKASH SINGH, J. Preliminary objection is raised by Mr. Nishant Shukla, learned counsel for respondent nos. 2 to 4 that the present writ petition is not maintainable on the pretext that the appointments are made by Navodaya Vidyala Samiti(NVS) on regional level and the present matter is of Lucknow Region as the deceased employee was working in Jawahar Navodaya Vidyalaya (JNV) in District Almora, Uttarakhand. The second set of objection is that the matter comes under the purview of recruitment as defined under section 14 of the Administrative Tribunal Act 1985, therefore, the writ petitioner is not maintainable as per the law settled law in the case of L.Chandra Kumar Versus Union of India reported in (1997) 3 SCC 261. Learned counsel appearing for the petitioner has failed to refute the aforesaid objections. He submits that he may be permitted to withdraw the instant writ petition to pursue the appropriate remedy. The writ petition is dismissed as sought above. Mr. Dev Rishi, advocate, holding brief of Mr. Varun Pandey, counsel for respondent no. 1 is present.
