HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 482 No. - 6147 of 2019 Court No. - 29 HON'BLE MANOJ BAJAJ, J. Applicant has approached this Court through this application under Section 482 Code of Criminal Procedure for quashing of the charge sheet dated 5.5.2019 as well as cognizance order dated 8.5.2019 passed by Chief Judicial Magistrate , Barabanki in Case No. 4702 of 2019, arising out of Case Crime No. 535 of 2018, under Sections 147, 148, 149, 302, 504, 506 I.P.C. and Section 7 Criminal Law Amendment Act, Police Station Mohammadpur Khala, District Barabanki, and the entire proceedings arising therefrom. When the case is called, no one has appeared on behalf of applicant. Learned A.G.A. is present. The initial order dated 2.9.2019 shows that the applicant raised the ground that at the time of alleged incident, the applicant was present in the premises of Tehsil Fatehpur, but the investigating officer has not analyzed the CCTV footage and his call details records to ascertain his actual involvement in the crime as alleged and the applicant also relied upon the regulation 107 U.P. Police Regulation Act to contend that the investigating officer violated the statutory provisions. It is the case of the applicant himself that the name of the applicant-accused surfaced in the statements of Monu Awasthi, Rajendra Prasad and Rakesh Awasthi and this fact is noticed in the order dated
20.9.2019. Since, the investigation stands completed as the charge sheet has already Versus Counsel for Applicant(s) : Ravi Shanker Singh Counsel for Opposite Party(s) : Govt. Advocate Vivek Mishra .....Applicant(s) State of U.P. and Another .....Opposite Party(s)
been submitted before the trial court, therefore, at this stage, this Court does not find it to be a fit case for exercise of inherent powers under Section 482 Cr.P.C. Most importantly, there is no interim order granted in favour of the applicant, much less staying the criminal proceedings, and with the passage of time, by now, the trial must have progressed. Thus, in the background of the case, no interference is called for. Resultantly, without meaning any expression of opinion on the merits of the case, the application fails and is hereby dismissed.
