HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1618 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No. 181/2025 U/S 308(2), 308(6), 352, 351(3) Β.N.S. (Old sections 334, 389, 504 and 506 I.P.C.) P.S.- Musafirkhana, District- Amethi. Heard learned counsel for the applicant and learned A.G.A. for the State. According to the prosecution, the first informant purchased land from Vimlesh, who later complained that the sale consideration was unpaid. Following this, the informant allegedly received threatening calls demanding repayment and warning of dire consequences. The callers, using abusive language, also threatened to falsely implicate him in criminal cases and harm his family and property, allegedly acting at the behest of the applicant and others. It is further alleged that on 09.07.2025, one Salim demanded Rs. 4,00,000 from the informant in a threatening manner, warning of false cases and physical harm if the amount was not paid. Learned counsel for the applicant submits that the applicant is innocent and has no criminal antecedents. It is contended that he has been falsely implicated in the present case and his name does not find place in the FIR. Learned A.G.A., on the contrary, opposes the prayer for anticipatory bail, Versus Counsel for Applicant(s) : Himanshu Singh Counsel for Opposite Party(s) : G.A. Harish Kumar Singh .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Home And Another .....Opposite Party(s) submitting that the investigation is still in progress. It is pointed out that the threatening calls were made from mobile number 9125146748, which is found to be registered in the name of the applicant. It is further submitted that custodial interrogation of the applicant is necessary. The plea of false implication cannot be accepted. Upon perusal of the record, it appears that prima facie scientific evidence exists against the applicant. Considering the nature of allegations, the requirement of custodial interrogation cannot be ruled out. Hence, it cannot be said to be a case of false implication. Accordingly, no case for grant of anticipatory bail is made out. The anticipatory bail application is, therefore, rejected. October 31, 2025 R.C. NABAIL No. 1618 of 2025 2 (Karunesh Singh Pawar,J.)
