JUSTICE A. GUNESHWAR SHARMA O R D E R 26-08-2025 [1] Heard Mr. S. Rupachandra, learned senior counsel for the petitioners/applicants and Mr. H. Debendra, learned Dy. Advocate General assisted by Mr. L. Somorendro Roy, learned junior Government counsel for the State respondents. [2] The petitioners and their men are occupying the land under C.S. Dag No. 4440, Patta No. 203 (Old), 145 (New) measuring an area of 0.02 acre situated at Village No. 75 Mayang Imphal. However, the petitioners are apprehending eviction from their patta land in terms of the notice dated 19- 08-2025 issued by the Sub-Divisional Officer, Wangoi, Imphal West in pursuance of mass eviction of encroachers from government land and by the present petition, the petitioners pray for restraining the respondents from carrying out eviction/demolition of structure within their patta land. [3] Mr. H. Debendra, learned Dy. Advocate General submits that Government is undergoing a mass drive for eviction from government land NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.08.26 17:41:17 +05'30' WP(C) No. 659 of 2025 & MC(WP(C)) No. 615 of 2025 and till now, no one has been evicted from their patta lands and no demolition is done within their patta lands and eviction and demolition are done upon government land encroachers after due verification. [4] This Court has considered the materials available on record and earlier orders passed in similar matters. As submitted by the learned Dy. Advocate General that the Government has not evicted any one from their patta lands and eviction is done only upon encroachers of government land after verification and the writ petition can be disposed of by directing the respondents first to verify possession of the petitioner and by following due process of law. [5] Eviction and demolition be done upon verification of encroachment upon government land and possession of petitioners and structures within patta land. It is clarified that there shall be no eviction and demolition within patta land. [6] With this observation, the writ petition is disposed of. [7] MC(WP(C)) No. 615 of 2025 also stands closed.
