The petitioner is seeking bail in Crime No.24 of2025 for the alleged offence under SectI'On 447, 120(B), 427, 379, 290, 506 r/w 34 of lPC along with Section 3 and 5 of Explosive Substances Act, Section 21(1), 21(4) of MMDR Act, Section 3(1 )(r), 3(2)(va), 3(2)(iii) of the sos and STs Act. 3. lt is submitted that the petitioner is arraigned as accused No.6 in the said crime allegedly on the statement made by the listed witness No.ll. ``-, Learned counsel for the`--petitioner submitted that the pauper was arrested
and sent to judicial custod-y on 23.03.2025.
It is submitted that the petitioner had also issued notice to L.W.15 on whose statement the police have registered crime under the provisions of sc and sT of Prevention of Atrocities Alct. 4. Heard learned Senior Counsel appearing for the L.W.15 and the learned Assistant Public Prosecutor. 5. Learned Assistant Public Prosecutor submits that 29 witnesses have been examI-ned SO far and that the Police have to retrieve the bank statements and other details relating to the account which was opened allegedly on the name of sister-in-law of the petitioner. It is submitted by the learned Assistant Public Prosecutor that the petitioner has opened a bank account on the name of his sister-in-law and that his mobile number is recorded as a contact number for the bank account. It is also submitted that the Police would require further time for investigating with regard to the quantum of material which was exported and the mode of transportatl-on of the said material. 6. Considering the submissions, at any rate, the investigating offl-cer has recorded statements of as many as 29 witnesses and the only thing which the Police are now required to collect is the documentary evidence which would available at the Chennai port and the nationalized bank with which the account on the name of Raja Rajeswari Logistics is maintained. These documents can be retrieved by Police by issuing appropriate correspondence to the concerned authorities. 7. Considering the submissions, the petitioner has been in.jail since 23.03.2025, he shall be enlarged on bail subject to petitioner furnishing personal bond for Rs.20,000/- (Rupees Twenty Thousand only), along with two sureties for a like sum each to the satisfaction of the V Additional District and Sessions Judge, Ne[lore. lt is further directed that the petitioner shall not tamper with the evidence or threaten the witnesses. The petitioner shall appear before the concerned Investigating officer on every 2nd and 4th Saturday of the month till finalisation of the charge sheetrfinal report. 8. With the above condition, the criminal petition is allowed. Misce[[aneous petitions, if any pending, in the Criminal Petition, sha[] h stand closed.
