This writ petition has been filed by the petitioners for the following reliefs :- 1. Issue a writ, order or direction in the nature of Mandamus, commanding and directing the Opposite Party No. 2 to stay the operation and effect of the Auction Notification dated 26.09.2025, whereby the Opposite Party No. 2 has scheduled the auction of the property in question on 13.10.2025, till the disposal of Revision under Section 41(3) of the Uttar Pradesh Urban Planning and Development Act, 1973. II. Issue a writ, order or direction in the nature of Mandamus, commanding and directing the Opposite Party No. 2 to stay the operation and effect of the Auction Notification dated 26.09.2025, whereby the Opposite Party No. 2 has scheduled the auction of the property in question on 13.10.2025, till the disposal of pending writ petitions as the matter is already under consideration before this Hon'ble High Court. Sri Utkarsh Tripathi, Advocate holding brief of Sri Shivendra S Singh Rathore, learned counsel for the petitioners prays that the writ petition may be dismissed as withdrawn with liberty to file a fresh writ petition for the same cause of action. The writ petition is dismissed as withdrawn with liberty as aforesaid.
