Court No. - 76 Case :- HABEAS CORPUS WRIT PETITION No. - 109 of 2025 Petitioner :- Aniruddh Pal Corpus And Another Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Moni Kishor,Mudit Agnihotri Counsel for Respondent :- G.A.,Shailendra Kumar Singh Hon'ble Vinod Diwakar,J.
1. Heard learned counsel for the petitioners, the learned A.G.A. for the State, and perused the record.
2. The present habeas corpus petition has been filed by petitioner no. 2 (wife) seeking release of petitioner no. 1 (husband) from the alleged illegal detention by respondent nos. 5 and 6, who are the parents of petitioner no. 1.
3. Learned counsel for the petitioners submits that the marriage between petitioner nos. 1 and 2 was solemnized on 14.12.2009 in accordance with Hindu rites and customs. From the said wedlock, two sons and a daughter were born. It is alleged that due to certain matrimonial disputes, petitioner no. 1 left the matrimonial home for Delhi on 12.08.2022 and has not returned since. Thereafter, respondent nos. 5 and 6 allegedly began harassing petitioner no. 2 and ultimately forced her to leave the matrimonial home. Upon intervention by relatives, petitioner no. 2 was permitted to return and now resides separately within the same premises. It is further alleged that petitioner no. 1 is being wrongfully confined by respondent nos. 5 and 6.
4. Upon perusal of the record and the submissions advanced, it appears that the dispute raised in the present petition primarily arises out of matrimonial discord and familial issues. The
allegations do not disclose a clear case of illegal detention in the strict sense required for invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India in the nature of habeas corpus.
5. In view of the nature of the dispute, this Court is of the considered view that no interference is warranted under the writ jurisdiction. The petitioners are at liberty to avail appropriate remedies before the competent court, including family or civil court, in accordance with law.
6. Accordingly, the writ petition stands dismissed with the aforesaid observations. Order Date :- 30.4.2025 Anil K. Sharma Vinod Diwakar, J. Digitally signed by :- ANIL KUMAR SHARMA High Court of Judicature at Allahabad
