APHC010247662025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3457] FRIDAY, THE TWENTIETH DAY OF JUNE TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 14724/2025 Between: Gavireddy Krishnam Raju ...PETITIONER AND The State Of Andhra Pradesh and Others ...RESPONDENT(S) Counsel for the Petitioner: 1. T V SRI DEVI Counsel for the Respondent(S): 1. GP FOR HOME The Court made the following: ORDER:- Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for the Home. 2. The learned counsel for the petitioner submits that the petitioner is aggrieved by the inaction of respondent Nos.3 to 5 in not taking necessary action on the petitioner’s representations dated 22.03.2025, 18.03.2025, 17.03.2025, 15.03.2025, 14.03.2025, and 08.03.2025. It is further submitted that respondent Nos.5 and 6, at the behest of respondent No.7, have not taken any action on the complaints filed by the petitioner. 3. It is submitted that the petitioner filed O.S.No.21 of 2024 on the file of the Civil Judge (Senior Division), Narsipatnam, with regard to the agricultural land of Yellavaram Dondapeta Revenue Mandal, Nathavaram Mandal, Anakapalli District. It is also submitted that respondent Nos.3 to 5 have not acted on the complaints, though there have been repeated complaints of trespass and damage to the property. It is further submitted that an injunction has been granted in favour of the petitioner. However, with the active support of respondent Nos.5 and 6, the respondent No.7 and her agents are creating trouble and damaging the property of the petitioner. 4. Admittedly, there are civil disputes pending between the petitioner and the unofficial respondents. However, that cannot be a ground for the unofficial respondents to interfere with and cause damage to the property. This Court cannot adjudicate on the involvement of the 7th respondent, and it is for the police to conduct a proper investigation into the complaints made by the petitioner by issuing appropriate notice to the concerned parties. 5. Accordingly, this Writ Petition is disposed off, directing the 3rd respondent to entrust the investigation to a proper officer on the complaint of the petitioner, duly taking into account the civil dispute pending between the petitioner and the unofficial respondents. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ___________________ JUSTICE HARINATH.N 20.06.2025 PNS
