HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1822 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Vakalatnama filed by Mrs. Suniti Sachan, Advocate on behalf of the complainant is taken on record. Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State as well as perused the record. The accused-applicant seeks anticipatory bail in Case Crime No.351 of 2025 under Section 109, 324 (2), 3(5) BNS, Police Station Mill Area, District Raebareli. Submission of learned counsel for the applicant is that the applicant is 63 years of age, has no criminal antecedents, and has been falsely implicated. It is further submitted that the injuries sustained by the alleged victim occurred in a road accident, and the prosecution story is exaggerated. Learned A.G.A., as well as learned counsel for the complainant, on the other hand, have vehemently opposed the bail application. Attention of this Court has been drawn by the learned counsel for the complainant to the medico-legal report of the informant from AIIMS Raebareli, which records seven injuries of different nature. The radiological report further indicates that the L3 and L4 vertebrae have sustained displaced fractures. Versus Counsel for Applicant(s) : Chhaya Tripathi Counsel for Opposite Party(s): G.A., Gangeshwar Pandey, Mrs.Suniti Sachan Abdul Wahab .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
Learned A.G.A., relying on the case diary, submits that the incident has been captured on CCTV footage. The injuries of the victim, corroborated by independent witnesses Ashish Yadav and Narendra Kumar Lodhi, support the prosecution case. Therefore, it cannot be said that the applicant has been falsely implicated. Perused the record. On due consideration of the submissions advanced and perusal of the record, it is evident that the applicant's complicity is reflected from the statement of the injured complainant. Further, the incident has been captured on CCTV footage, which forms part of the case diary. Considering the nature of the injuries sustained by the injured and the gravity of the offence, it cannot be said that the applicant has been falsely implicated. No case for anticipatory bail is made out. Anticipatory bail is an extraordinary remedy, intended to be exercised only in exceptional circumstances, where the Court is satisfied that the applicant has been falsely implicated or where no material exists to justify custodial interrogation.
In view of the above, the anticipatory bail application is rejected. November 27, 2025 Madhu D.R/P.S NABAIL No. 1822 of 2025 2 (Karunesh Singh Pawar,J.) Digitally signed by :- MADHU KUMARI High Court of Judicature at Allahabad, Lucknow Bench
