M.Subramanya Bhat, learned counsel for the petitioners and learned counsel Sri. Charan Raj.N. for Sri.Jagadeesh Mundaragi, learned counsel for the respondents. Perused the writ petition papers. 2. Learned counsel for the petitioners would submit that the petitioners are before this Court under Article 226 of the Constitution of India, praying for a mandamus to direct the respondents to pay all the monetary benefits namely arrears of salary, increments, etc., along with interest as he has continued in employment till he attained the age of superannuation. But learned counsel for the petitioners would submit that the mandamus was sought on the basis of order passed by this Court dated 20.06.2012 in W.P.No.14522/2008 and the said order is reversed in W.A.No.8281/2012 dated 28.05.2024 which is placed on record by the respondents along with memo dated 12.07.2024. In view of the judgment in W.A.No.8281/2012, the prayer of the petitioners would no more survive for consideration. - 4 - NC: 2025:KHC:6450 WP No. 10282 of 2014 3. Learned counsel for the respondents also would submit that the Division Bench of this Court under its judgment dated 28.05.2024 allowed the writ appeal and set aside the order of the learned Single Judge. 4. In view of the order of the Division Bench passed in W.A.No.8281/2012 dated 28.05.2024, the petitioners would not be entitled for mandamus as sought. With the above, writ petition stands rejected.
