Heard Mr. D. Majumdar, learned Addl. Advocate General assisted by Mr. R. Dhar, learned Government Advocate appearing for the State. The petitioner in the present proceeding has presented a challenge to the decision arrived at by the State Level Committee (SLC) in its meeting held on 13.08.2008 and has further prayed for a direction to the respondent authorities to Page No.# 3/3 consider his case for appointment on compassionate grounds. As projected in the writ petition, the father of the petitioner while serving as an Assistant Sub-Inspector of police had died in harness on 09.03.1969. The petitioner, admittedly, at the time of death of his father was a minor. The petitioner, on reaching the age of majority, submitted an application for consideration of his case for appointment on compassionate grounds. The matter, thereafter, on being recommended by the DLC came to be placed before the SLC in its meeting held on 13.08.2024. However, the said committee rejected the case of the petitioner herein. The SLC in its said meeting had rejected the case of the petitioner on the ground that the application as submitted by him on 23.09.2005 has lost its force on account of non-consideration of the same within two years from the date of submission of the said application. It is seen that the petitioner, as on date, is around 54 years and the petitioner, admittedly, is over aged for being considered for appointment into any government job. Further, the death of the father of the petitioner having occasioned on 09.03.1969; after a lapse of around more than 50 years, no direction is called upon to the respondent authorities for consideration of the case of the petitioner for appointment on compassionate grounds. For the above reasons, this Court is of the considered view that the writ petition is devoid of merit and accordingly, the same stands dismissed. JUDGE Comparing Assistant
