The learned counsel for the petitioners submit that the 2nd respondent at the behest of the 3rd respondent has registered a crime No.60 of 2025 on the file of Narsaraopet I Town Police Station for the alleged offences under Sections 329(4), 324(4), 79 read with 3(5) of BNS. 2. The learned counsel for the petitioners submits that the 3rd respondent is the sister of 1st petitioner and that the dispute over the family property. It is submitted that the 1stpetitioner has filed a civil suit for injunction restraining the 3rd respondent from interfering with the possession and enjoyment of the 1st petitioner. The 3rd respondent has also filed another suit seeking declaration of title over the said property 3. It is submitted that without referring to any of the civil suits, a complaint was filed by the 3rd respondent on 18.04.2025 alleging various offences. It is submitted that the police have issued notice under Section 35(3) of BNSS after filing the present writ petition. 4. The learned Assistant Government Pleader on written instructions submits that the accused in Crime No.60 of 2025 are absconding and that they are not responding to the notice. 5. However, considering the submissions of the learned counsel for the petitioners that the notice under Section 35(3) of BNSS has issued and that the police shall complete the investigation strictly in accordance with Section 35(3) of BNSS and the 2nd respondent shall not interfere with the civil disputes pending between the parties. 6. Accordingly, the writ petition is disposed off without costs.
