HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7144 of 2024 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA for the State, Shri Anil Kumar Tiwari, learned counsel for the informant and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 106 of 2020, under Sections 376 IPC and Sections 3/4 POCSO Act, P.S. Madiyaoun, District Lucknow. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that daughter of the informant aged about 13 years was alone at home and on the date of incident i.e. 30.1.2020 the applicant had committed wrong on her. In the statement under Section 161 Cr.P.C. the victim stated that she knew the applicant for around one month. Similar statement was given under Section 164 Cr.P.C. The tentative age of the victim is around 14 years. The medical report on record does not corroborate the allegations of use of force. The trial court report is also considered which indicates that the statement of the victim itself was recorded on 19.10.2024 i.e. after four years of the date of alleged incident. 4. Learned AGA has opposed the bail application. 5. Considering the medical report, however, without commenting upon the merits of the case, the applicant who is in jail since 15.2.2024 and has no criminal history is entitled to be enlarged on bail.
