Learned counsel for the petitioners seeks permission of this Court to withdraw this petition with liberty to prefer a duly constituted appeal before the Appellate Authority under the Payment of Gratuity Act, 1972.
2. No objection from the other side.
3. Permission is granted.
4. With the aforesaid liberty, this petition is dismissed as withdrawn. If the petitioners prefer an appeal before the Appellate Authority, the same shall be decided expeditiously and strictly in accordance with law. While doing so, the Appellate Authority shall also take into
consideration the fact that the matter remained pending before this Court for a considerable period. The petitioner would be at liberty to move an application for grant of stay alongwith the memo of appeal within a period of 15 days from today. The Appellate Authority is
directed to decide the said application for stay within a further period of 30 days after affording an opportunity of hearing to the parties concerned.
5. Interim order granted on 3.5.2024 shall continue for a period of 45 days from today.
6. Certified copy of the order be returned back to counsel for the petitioners after retaining its xerox copy in the record. Sd/-
