Biswas, the learned counsel for the applicants. 2. This application under Order XXII Rule 4 of the Code of Civil Procedure, 1908 has been preferred by the applicants for substituting the legal heirs of the deceased respondent No. 1, namely, Sri Jatindra Nath Bharali in his place in the memo of appeal in RSA No. 59/2009. 3. By an order dated 21.04.2025 in I.A. (Civil) No. 3190/2024, the delay in preferring the present application for substitution of the legal heirs of the respondent No. 1 has already been condoned. 4. After considering the averments made in the instant application, the prayer for substituting the legal heirs of the respondent No. 1, namely, Smti. Charuma Bharali, Sri Raj Bharali, Sri Raja Bharali and Sri Rana Bharali be substituted as respondent Nos. 1(a), 1(b), 1(c) and 1(d) in the memo of appeal of connected RSA No. 59/2009. 5. List the connected RSA after 2(two) weeks, from the date of this order. Page No.# 4/4 6. This Interlocutory Application is accordingly disposed of. 7. The applicants are directed to submit the amended cause title in the connected RSA No. 59/2009 by showing the names of the substituted legal heirs of the respondent No. 1 in their new addresses.
