HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 10336 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J.
HON'BLE MRS. BABITA RANI, J.
1. Heard learned counsel for the petitioner and learned A.G.A. appearing for the State respondents.
2. With the consent of the parties, the matter is being finally decided.
3. By means of this petition, the petitioner has raised a challenge to the FIR dated 20.09.2025 in Case Crime No.201 of 2025 under Section 8/20 N.D.P.S. Act, Police Station Jagatpur, District Raebareli, as contained in Annexure 1 to the writ petition.
4. The contention of learned counsel for the petitioner is that the aforesaid FIR has been lodged by the authorities themselves against Sri Atul Singh alias Tipu and the petitioner. From the version of the FIR, it emerges that Atul Singh @ Tipu had been caught with contraband and in a statement he has named the petitioner also.
5. Further contention is that simply on the basis of the confessional statement of the person who has been caught, the petitioner cannot be roped in the entire episode. The respondents are not having any cogent or credible evidence against him and yet are harassing the petitioner under the pretext of the aforesaid FIR.
6. At this stage, learned AGA states that the investigation is still going on against the petitioner and that it is only on the basis of the statement of the Versus Counsel for Petitioner(s) : Dilip Kumar Pandey Counsel for Respondent(s) : G.A. Bablu @ Bal Krishna .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Lko. And 4 Others .....Respondent(s)
main accused, namely, Atul Singh @ Tipu, petitioner has been named in the FIR.
7. Considering the aforesaid, the writ petition is disposed of with the direction to the respondent authorities not to take coercive action on the basis of the impugned FIR till some credible/cogent evidence is found against him.
8. At this stage learned AGA states that the statement of the petitioner is required. For this purposes, the petitioner may appear before the competent authority on 24.11.2025 at 11.00 am. for recording of his statement.
