HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 947 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J. HON'BLE RAJEEV BHARTI, J. 1. Heard. 2. Petitioner has filed this public interest litigation seeking the following reliefs:- "(i). issue the a writ, order or direction in the nature of Mandamus commanding State Government to conduct a deep and pervasive enquiry in respect of financial embezzlement and administrative non functioning of the respondent no.5, namely "Antarashtriya Ramayan and Vedic Shodh Sansthan, Tulsi Smarak Bhawan, Ayodhya" as per its Bye Laws which is an autonomous body under the Government of U.P. (ii). issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to make regular and proper appointment from the public at large to the Director post of of the and Institution Vedic Shodh "Antarashtriya Ramayan Sansthan, Tulsi Smarak Bhawan, Ayodhya" as per the bye-laws of the institution after proper advertisement. (iii). issue any other suitable order or direction which this Hon'ble Court may deem fit, just and proper under the circumstances of the case. (iv). to allow the writ petition of the petitioner with cost." 3. On being asked as to what is the source of the documents which have been annexed with the writ petition, it was informed that they have been Versus Counsel for Petitioner(s) : Santosh Kumar Misra Counsel for Respondent(s) : A.S.G.I., Anurag Tyagi, C.S.C. Shivam Singh .....Petitioner(s) U.O.I. Thru. Its Secy. Ministry Of Art And Culture, New Delhi And 4 Others .....Respondent(s) obtained under the Right to Information Act, however, we do not find any categorical pleading in the writ petition to the effect that all the documents annexed with the writ petition have been obtained by the petitioner under Right to Information Act. Even otherwise, the opposite party no.5 is a society registered under the Society Registration Act, 1860 for a particular purpose. Its officer bearers are State Government officials. The governing body comprises of high officials of the Government. Merely because some person has been appointed as O.S.D. through outsourcing, we fail to understand as to what illegality has been committed in this regard by the Director. This is hardly a ground for being raised in a public interest litigation. As regards the alleged financial embezzlement, learned counsel for the petitioner has invited our attention to page no.143 which refers to some information provided under the Right to Information Act in response to an application submitted by the petitioner under the Right to Information Act dated 18.07.2024. There is a list appended to the said document but it appears that it is not a complete list. In the first column, Sl. nos.9, 12, 14 etc are mentioned which are not in seriatim. We do not know what these numbers mean. Column 2 contains the names of M.R. Travels and Dreams 360. Column 2 refers to some amount. Column 3 again refers to some figures. These columns are without any heading, therefore, we are unable to comprehend as to what the figures mentioned in the columns signify. These data appear to be pertaining to the year 2022 and 2023. The last column refers to some figures in rupees. Again it is not clear as to what those figures signify. These documents by itself do not help us in arriving at any conclusion regarding any alleged embezzlement of the funds of the society. Learned counsel for the petitioner has further invited our attention to a document dated 26.10.2024 wherein Sri Ashutosh Dwivedi, Consultant, Antarashtriya Ramayan and Vedic Shodh Sansthan has been assigned some work relating to 'Videshi Ramleela Ki Prastuti' whereas his appointment as such is of 30.10.2024 as evident from Annexure no.7. The submission is that how work could be allotted to him prior to his appointment. These are all matters to be seen by the concerned officials of the Government who are part of the governing body of the society. This by itself does not persuade us to entertain this P.I.L. especially as, according to Sri Anurag Tyagi, learned counsel appearing for opposite WPIL No. 947 of 2025 2 party no.5, approval for engagement of Sri Ashutosh Dwivedi had been granted by the Chairman of opposite party no.5 / Principal Secretary, Tourism & Culture Department of the Government on 21.10.2024 itself. We leave it open for the petitioner to move appropriate application before the aforesaid Principal Secretary who is now the Additional Chief Secretary raising all grievances who can get the matter looked into but we see no reason to proceed any further in this matter. 4. Accordingly, the petition is disposed of. October 31, 2025 Shanu/- WPIL No. 947 of 2025 3 (Rajeev Bharti,J.) (Rajan Roy,J.)
