So far as the impugned order is concerned, it does not speaks anything regarding the jurisdiction of Sessions Judge, Hardoi for considering the application under Section 156(3) Cr.P.C., neither learned counsel for the applicant is able to clarify the jurisdiction of Sessions Judge, for entertaining the application under Section 156(3) Cr.P.C. In the copy of application under Section 156(3) Cr.P.C., there is a mention of allegation of corruption against the S.H.O. of Police Station-Pali and others. 5. The Hon’ble Supreme Court, in Anil Kumar & Ors. v. M.K. Aiyappa & Anr., reported in (2013) 10 SCC 705, has categorically held that prior sanction is mandatory even at the pre-cognizance stage. It has been further laid down that a Special Judge or Magistrate cannot refer a private complaint against a public servant for investigation under Section 156(3) of the Code of Criminal Procedure, 1973, unless the complaint is accompanied by a valid sanction order under Section 19 of the Prevention of Corruption Act, 1988. In the absence of such sanction, the application under Section 156(3) Cr.P.C. is not maintainable before the Sessions Judge, Hardoi. 6. In view of the aforesaid settled legal position and the discussions made hereinabove, no interference is warranted with the impugned order. Consequently, the instant application stands rejected.
