Satya Charan Sharma & Ors. Versus The State of West Bengal & Ors.
Mr. Amarta Ghose Ms. Rituparna De Ghose Mr. Souryadeep Ghosh
…for the petitioners.
Mr. Supriyo Chattopadhyay Mr. D. Chatterjee
…for the respondent nos. 10, 11 & 12.
Mr. Sirsanya Bandopadhyay, Sr. St. Counsel Mr. Akash Dutta
…for the state.
Petitioner and the private respondents are contesting before the civil court in respect of the disputes arising out of construction on the land which is one of the subject matter referred to in the writ petition. However, the grievance of the petitioner is that another case has been registered by Liluah Police Station on the basis of an information furnished by respondent no. 11 Pawan Kumar Sharma being Liluah Police Station Case No. 88/2025. Learned advocate appearing for the petitioner submits that the said case is a counter- blast to the previous case which was instituted at
2 the behest of the petitioner no. 8 namely, Bijay Sharma. Petitioners apprehend that the present case has been foisted upon them by way of a vendetta without having any factual foundation. On the other hand, learned advocate appearing for the private respondents submits that there are allegations under section 117(4) and section 109 of BNS which itself would reflect that there must be bodily injury inflicted upon a victim. As such, the issue relating to vendetta can prima facie be ruled out. In view of the civil court already in seisin of the issue and number of criminal cases now pending inter se the parties, I am of the opinion that the police authorities would with strict conditions ensure that no further untoward incident takes place and would in course of investigation unearth the truth for the purposes of arriving at a conclusion in connection with Liluah Police Station Case No. 88/2025. With the aforesaid observations WPA 7670 of 2025 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
