Santhosh Government Advocate (Criminal Side) 1 / 6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.34411 of 2025 O R D E R This Criminal Original Petition has been filed seeking to quash the proceedings against the petitioners in C.C.No.75 of 2025 on the file of the learned Judicial Magistrate, Pappireddipatti. 2. The case of the prosecution is that on 27.07.2023, at about 08.30 a.m. when the de facto complainant was in her agricultural land, the petitioners/accused 1 to 6 trespassed into the said property by allegedly breaking open the lock and abused the de facto complainant in filthy language and criminally intimidated her demanding to vacate the land. During the said occurrence, the accused 1 slapped her on the cheek while the accused 2 allegedly beat her on the hip using a bamboo stick. When the husband of the de facto complainant intervened, he was also attacked by the accused 1 and 2 and he suffered injuries. The accused 3 to 6 also assaulted the de facto complainant’s husband by striking on his back with a coconut stem. Thereafter, all the accused persons criminally intimidated the de facto complainant and her husband by threatening them with dire consequences. Therefore, the first respondent police registered a case and thereafter, filed a final report against the accused persons under Sections 147, 448, 294(b), 323, 324 and 506(i) of the Indian Penal Code and Section 4 of the Tamil 2 / 6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.34411 of 2025 Nadu Prohibition of Harassment of Women Act, 2002. 3. The learned counsel appearing for the petitioners submitted that the entire complaint is false, fabricated and motivated due to the prior land dispute. The petitioners have given a counter complaint, however, no proper investigation was done and the case was referred as mistake of fact on the ground that the dispute was civil in nature. 4. Per contra, Mr.S.Santhosh, learned Government Advocate (Criminal Side) appearing for the first respondent submitted that though this case is an off-shoot of the civil dispute, the petitioners have abused and assaulted the de facto complainant and her husband resulting in they sustaining injuries and there is also a doctor’s report stating about the injuries. Therefore, there are materials to proceed against the petitioners. 5. Having gone through the records, this Court finds that there are materials against the petitioners. Hence, this Court is not inclined to quash the proceedings in C.C.No.75 of 2025 on the file of the learned Judicial Magistrate, Pappireddipatti. At this juncture, the learned counsel appearing for the petitioners requested this Court to dispense with the personal appearance of the petitioners before the trial Court. 7. Considering the request of the learned counsel for the petitioners, the personal appearance of the petitioners before the trial Court is dispensed with for the present, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or any other date as may be required by the trial Court.
