K SUBRAHMANYAM The Court made the following: ORDER: The grievance of the petitioners is that the respondents did not consider their representations dated 21.02.2022 and 19.03.2022 submitted for removal of encroachments of the Nagidipalem Tank to an extent of Ac.3.83 cents in R.S.No.204 and encroachments in R.S.No.205 of Nagidipalem Village, Bhimavaram Mandal, West Godavari District. 2. Heard Sri V.Roopesh Kumar Reddy, learned counsel for the petitioners, Sri Yallabandi Ramatirtha & Sri K.Subrahmanyam, learned counsel for unofficial respondents and learned Assistant Government Pleader for Revenue. 3. Learned counsel for the petitioners in elaboration to what has been stated in the writ affidavit submitted that the petitioners made representations dated 21.02.2022 and 19.03.2022 for removal of encroachments in the subject land wherein no action has been initiated on the same. It would suffice for the time being if a direction is given to the respondents to take steps in accordance with law. 4. On the other hand, learned Assistant Government Pleader on counter contended that that on the representation dated 21.02.2022, the Secretary Gram Panchayat, Nagidipalem, has given reply to the petitioners informing that the gravel of the tank is being utilized by the Gram Panchayat for Government works only and the representation dated 19.03.2022 has not been received by the 4th respondent. Further, the Secretary Gram Panchayat, Nagidipalem, has issued notices to all the encroachers in R.S.No.204 Tank Poramboke and taking steps to remove the encroachments soon, as such, prayed to dismiss the writ petition. 5. A perusal of the counter would indicate that the respondent authorities have already issued notices to the encroachers and they are taking steps to remove the encroachments but nowhere it is stated that as to what has happened after that. However, as the respondent authorities have an intention to take steps on the petitioners representation and as already action has been initiated, there is no purpose in keeping the writ petition pending, as such, this Court is inclined to dispose of the writ petition by passing the following order: “The respondent authorities are directed to consider and dispose of the petitioners representation dated 19.03.2022 and if any encroachments as mentioned in their representation found place, they shall to take steps in accordance with law by giving proper notice.” 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
