HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6705 of 2025 Court No. - 19 HON'BLE RAM MANOHAR NARAYAN MISHRA, J. 1. Heard learned counsel for the petitioners and perused the record. 2. The instant petition under Article 227 of the Constitution of India has been filed with a prayer to issue directions to the learned Additional District Judge, Court No.3, Bahraich, to decide the Civil Appeal No.10 of 2023, which is pending before him, expeditiously, within a reasonable period. 3. Learned counsel for the petitioners submits that the respondents are the plaintiffs before the court of first instance in Regular Suit No.855 of 1994. The appellants are respondents in Civil Appeal No.10 of 2023, arising out of judgment and decree dated 25.01.2023, passed by the learned Civil Judge, Avar Khand, Kaisarganj, District Bahraich, in Regular Suit No.855 of 1994, whereby the suit filed by the plaintiffs-respondents was decreed. The appeal filed by the appellants has been pending before the appellate court since 14.03.2023 i.e. for a period of more than two and a half years. The plaintiff-respondents are deprived of the fruits of the decree passed in their favour, therefore, necessary directions may be issued to the appellate court to expedite the same. 4. No useful purpose of law would be served to keep the petition pending before this Court and taking into consideration the limited prayer made therein. The appellate court is directed to make every effort to hear and decide the Civil Appeal No.10 of 2023 pending before it, in an expeditious manner, without granting unmerited adjournments to any Versus Counsel for Petitioner(s) : Pawan Kumar Singh Counsel for Respondent(s) : Ram Narayan And Another .....Petitioner(s) Vijay Bahadur And 4 Others .....Respondent(s) party and to decide the same within a reasonable period. 5. With the above directions, the petition is disposed of. November 17, 2025 Mohd. Sharif A227 No. 6705 of 2025 2 (Ram Manohar Narayan Mishra,J.)
