HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 5098 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. None appears for the informant despite notice. 2. The applicant seeks enlargement on bail in FIR No. 30 of 2025, under sections 65(1), 332(B), 351(3) BNS, Section 4(2) POCSO Act, P.S. Nagram, District Lucknow. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that daughter of the informant aged about 14 years was at home and preparing the examination when the applicant came into home and committed wrong on her. In the statement under Section 180 BNSS the victim reiterated the said statement. In the statement under Section 183 BNSS the victim stated that at the time of incident her sister and grandmother were also sleeping besides her when the applicant came and committed wrong on her. The medical on record does not indicate presence of any fresh injury. There is no definite document with regard to exact age of the victim. Considering the statement of the victim that the sister and grandmother were sleeping besides her at the time of incident the allegations appears to be improbable. 4.
