Instant appeal has been filed by the appellant challenging the impugned judgment and order dated 27.10.2025 passed by the learned Special Judge, SC/ST Act, Lucknow (in short 'trial Court') in Final Report No. 402 of 2025 (Ramesh Kumar Mandal vs. Ashish Singh) as also with the prayer to treat the protest petition as complaint. 4. Vide impugned order dated 27.10.2025 the trial Court rejected the protest petition and the affirmed the final report submitted by the police authorities. 5. Fact(s), in brief, of the case are as under:- (i) Some hot talk took place between the appellant and opposite party No. 2 on 31.08.2024 in the Office of Senior Division Engineer (Air Conditioning), Charbagh, Lucknow at 11:35 hours. (ii) The aforesaid is evident from the application dated 31.08.2024 submitted by the appellant before the Senior Division Engineer (Electric) Air Conditioning, Charbagh, Lucknow. Copy of which is annexed as Annexure No. 1 to the supplementary affidavit dated 19.11.2024. (iii) The aforesaid hot talk took place on account of the fact that the opposite party No. 2 came late in the Office. Lko And Another .....Respondent(s) (iv) It further appears from the aforesaid application dated 31.08.2024 of the appellant that opposite party No. 2 in hot talk hurled abuses and threatened the appellant. Relevant portion of the application dated 31.08.224 reads as under:- "सेवा मȅ, थाना Šभारी, आलमबाग, लखनऊ िवषयः- ũी आिशष िसह टे० 1 DZारा Šाथȃ के ऊपर जानलेवा हमला करने के सęदभă मȅ। महोदय, सिवनय िनवेदन है िक Šाथȃ रमेश कु मार मंडल पद व० खĔड अिभयęता ए०सी आिफस मȅ इंचाजă के ɳप मȅ कायăरत है Šाथȃ आज िदनाक-31/08/2024 के अपने कायाăलय चारबाग लखनऊ मȅ िनयिमत ɳप से कायă करा रहा था उस समय मेरे आिफस मȅ िनĞनवत घटना ɷई। 1-ũी आिशष िसह टेĆनी0-1 पुś ũी सęतराम जाित ठाकु र लगभग 11.35 वजे आिफस आये जबिक आिफस का समय 9 से 17 बजे का है। जब देर से आने से टोका गया तो लडाई करने पर आमदा हो गया तथा उġटी सीधी हरकते करते ɷए Šाथȃ को गाली गलौज देने लगा एवं जाित सूचक एवं आिदवासी-2 िचġलाने लगा। आिशष िसह हमेशा अवैध हिथयार लेकर चलता है एवं हमेशा अęय सुपरवाइजरȋ को धमकता रहता है। आज की घटना की जानकारी अपने Ţाęच अिधकारी Sr. DEE को िदया तो उęहȋने तुरęत कमăचारी को िनलिĞबत कर िदया। Šाथȃ को पुनः बताया िक मȈने रात मȅ एक सुपरवाइजर SSE के घर पथराव ɷआ है तुĞहारा भी िनपटारा करȅगे। पुनः शायं 6.30 बजे Šाथȃ अपने आवाश ओġड आर डी0 एस0ओ0 कालोनी मȅ जा रहा था तभी आलमबाग वकă शाप के पास लगभग 6, 7 लíके जो िक राĥते मȅ दो, तीन जगह खíे थे िजसमȅ आिशष िसह भी था लोहे की राड से हमला करने लगे तभी राहगीरȋ को िचġलाकर मैने रोका और मदद मांगी। जब अिधक राहगीर आ गये तब वे लोग वहा से भाग िनकले। अतः ũीमानजी से िनवेदन है Šाथȃ की िशकायत दजă कर उǘ कमăचारी के िखलाफ उिचत कायăवाही (FIR) दजă करने की कृ पा करȅ। यिद भिवĤय मȅ मेरे िखलाफ कोई अनहोनी घटना होती है तो उसके िजĞमेदार आिशष िसह पुś ũी सęतराम पद टेĆनी 0-1 कायाăलय व०ख०अ० (वाता) चारबाग मो0नं0-9335882917, 9839256293 ही होगा।" (v) Taking note of contents of the application dated 31.08.2024, the opposite party No. 2 was suspended on the same day i.e. 31.08.2024 and he has not been reinstated till date as appears from the copy of order dated 03.09.2024 annexed as Annexure No. 9 to the appeal. (vi) After the aforesaid the appellant lodged the FIR on 07.09.2024, registered as FIR No. 0160 of 2024 under Sections 115(2), 127(1), 190, 191(2), 352 BNS and 3(1)Da and 3(1)Dha of SC/ST Act, making allegations therein against the opposite party No.2 and also against 6-7 other unknown persons. (vii) In the FIR aforesaid it has been alleged that on 31.08.2024 at about 06:30 PM the opposite party No. 2 alongwith 6-7 unknown persons assaulted CRLA No. 3748 of 2025 2 the appellant with steel rod while the appellant was going to his home and also hurled abuses and made caste based remarks against the appellant. Relevant portion of the FIR is extracted here-in-under:- "सेवा मȅ ũी मान् थाना Šभारी, आलमबाग, लखनऊ िवषय- ũी-आिशष िसह, टेिĆन0- 1 DZारा Šाथȃ के ऊपर जानलेवा हमला करने के सĞबęध मȅ। महोदय, सिवनय िनवेटन यह है िक Šाथȃ रमेश कु मार मंडल पद- व०ख०अिभ०, एसी कȋिचक चारबाग ऑिफस मȅ िडपो इंचाजă के पद पर कायăरत है। Šाथȃ िदनाक 31.08.2024 को शायं 6:30 बजे अपने आवास ओġड आर.डी.एस.ओ. कलोनी जा रहा था, तभी अलमबाग वकă शप के पास लगभग 6, 7 लíके जो िक राĥते मȅ दो-तीन जगह खíे थे िजसमे आिशष िसह भी था Šाथȃ को रोककर गली गलौज के साथ जाितसूचक शĜद आिदवासी- आिदवासी बोलते ɷए लोहे की राड से हमला िकया। तभी Šाथȃ राहगीरो को आवाज लगाकर रोका और मदद मांगी। जब अिधक राहगीर आ गये तब वे लोग वहाँ से भाग िनकला। अतः ũी मान से िनवेदन है िक Šाथȃ की िशकायत दजă कर उिचत कायăवाही करने की कृ पा करȅ। यिद भिवĤय मे Šाथȃ के साथ या पिरवार के साथ कोई अनहोनी घटना होती है तो इसके िजĞमेवार ũी आिशष िसह हȋगे।" (viii) After lodging of the FIR the Investigating Officer (in short 'I.O.') carried out the investigation and submitted the final report, according to which, no such incident as indicated in the FIR was occurred on 31.08.2024 at about 06:30 PM. (ix) After considering the facts of the case the Court concerned directed the I.O. to submit the fresh final report after taking note of C.C.T.V. footage and C.D.R. as also recording the statement(s) of the witnesses of the prosecution before Camera. (x) After the aforesaid the I.O. submitted that final report dated 19.05.2025 to which appellant preferred protest petition and the trial Court vide impugned order dated 27.10.2025 rejected the same and affirmed the final report. Relevant portion of the order dated 27.10.2025 reads as under:- "पśावली पेश ɷई। पुकार करायी गयी। वादी के िवDZान अिधवǘा उपिĥथत। उनकी ओर से Šोटेĥट पीिटशन समिथत शपथ पś इस आशय का िदया गया है िक नामजद अिभयुǘ आशीष िसह एवं 6 अęय ने वादी को िदनाक 31.08.2024 को मारा पीटा था, जब वह घर जा रहा था और 7 िदन बाद उसकी एफ०आई०आर० आलमबाग थाने मȅ दजă ɷई थी तथा मेिडकल कराया गया था और कोई चोट नहȂ पायी गयी। इसके पहले िववेचक ने िदनांक 02.11.2024 को अंितम िरपोटă Šेिषत कर दी गयी थी तथा अिŎम िववेचना के बाद पुनः उęहȂ साĨयȋ के आधार पर अंितम िरपोटă Šेिषत कर दी गयी है। वादी ने अपने विरǹ अिधकािरयȋ को इस आशय का पś Šेिषत िकया था िक आशीष िसह झगडालू Šकृ ित का है और बाहरी लोगȋ को लाकर मारपीट करता है। िदनांक 31.08.2024 को अिभयुǘगण ने बाहरी लोगȋ अनुराग िमũा, सĕयजीत िसह, पवन ũीवाĥतव के समW वादी को जान से मारने की धमकी दी थी। यह िक िदनांक 03.09.2024 को सीिनयर डी०ई०ई० ने पुिलस िनरीWक, आलमबाग को Šेिषत िकया था िक आशीष िसह िनलंिबत कर िदया गया है। यह िक जब वादी ने अिभयुǘ आशीष िसह को यह सूचना दी िक उसका ĥथानाęतरण हो गया तब आशीष िसह ने 10-15 अXात लोगȋ के साथ वादी व अęय इंजीिनयर को मारने की धमकी दी थी। यह िक आशीष िसह के िखलाफ अनेक िशकायते हȈ िक वह अपने विरǹ अिधकािरयȋ से गाली गलौज व झगíा करता रहता है। यह िक संजय अरोíा ने अपने बयान मȅ यह कहा था िक आशीष िसह और राम सुधीर यादव िदनांक 31.08.2024 को ɭकान पर आये थे। यह िक घटना ĥथल आलमबाग वकă शाप के िनकट है, लेिकन िववेचक ने जानबूझकर उसे अęयś िदखलाया है। यह िक मोबाइल नंबर की सी०डी०आर० नहȂ ली गयी है तथा न ही धारा 63 CRLA No. 3748 of 2025 3 भारतीय साĨय अिधिनयम का Šमाण पś िलया गया है। उपरोǘ तĖयȋ के ɯिǸगत यह अनुरोध िकया गया है िक एफ०आर० को िनरĥत करते ɷए आशीष िसह को तलब करके दिĔडत िकया जाये। सुना एवं पśावली का अवलोकन िकया। के स डायरी के पचाă नं0 1 मȅ गवाह अनुराग िमũा, सĕयजीतिसह, पवन ũीवाĥतव अंिकत िकया गया है, िजनके DZारा घटना का समथăन नहȂ िकया गया है। इसके अितिरǘ पिरिĥथितजęय साWी सुरजीत िसह का बयान िववेचक DZारा अंिकत िकया गया है, िजसने भी घटना का समथăन िकया है। िववेचक DZारा संŎिहत साĨय से भी ĥपǸ है िक घटना का ĥवतęś एवं चģमदीद सािथयȋ DZारा समथăन नहȂ िकया गया है। विणत पिरिĥथितयȋ मȅ अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3(1)10 एस०सी०/एस०टी० ऐĆट थाना-आलमबाग, िजला लखनऊ मȅ Šĥतुत अंितम आćया िदनांिकत 19.05.2025 ĥवीकार िकये जाने योĈय है और उस पर आधािरत एफ०आर० वाद 402/2025 िनĥतािरत िकये जाने योĈय है। आदेश अंितम आćया िदनांिकत 19.05.2025 ĥवीकार की जाती है एवं उस पर आधािरत एफ०आर० वाद संćया 402/2025 मु०अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3 (1)10 एस०सी०/एस०टी० ऐĆट थाना-आलमबाग, िजला लखनऊ तėनुसार िनĥतािरत की जाती है। पśावली िनयमानुसार दािखल दěतर हो।" 6. In the aforesaid background of the case, the instant appeal has been filed. 7. Learned counsel for the appellant has impeached the order dated 27.10.2025 on the following ground(s):- (i) Certificate under Section 65(B) was not submitted by the I.O. and despite this the trial Court passed the order impugned. (ii) Statement(s) of witnesses of the prosecution were not recorded before the Camera. (iii) The order impugned is non-speaking and un-reasoned. 8. Learned AGA for the State-Sri Ajay Kumar Srivastava opposed the instant appeal. He stated that the case set up by the appellant in the FIR is completely bogus and it appears that with oblique motive the FIR has been lodged that too with delay of seven days. Prayer is to dismiss the appeal. 9. Upon due consideration of aforesaid, the material available on record, submissions of the learned counsel for the parties as also the impugned order, this Court finds that no interference is required. It is for the following reason(s):- (i) Application dated 31.08.2024 states that on 31.08.2024 hot talk took place between the appellant and opposite party No. 2 on the issue related to CRLA No. 3748 of 2025 4 attending the Office with some delay. (ii) Considering the contents of the application dated 31.08.2024 of the appellant as gospel truth the opposite party No.2 was suspended on the same day i.e. 31.08.2024. (iii) The FIR was lodged by the appellant on the basis of written report submitted by him before the S.H.O. concerned on 07.09.2024 and according to the same, the appellant ought to have sustained some grievous injuries as in the FIR it has been indicated that the opposite party No. 2 alongwith 6-7 unknown persons assaulted the appellant with steel rod. However, no injury was sustained by the appellant. (iv) Observations made in the impugned order dated 27.10.2025 that the opposite party No. 2 was present at some other place has not been impeached. 10.
