HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6966 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Ramesh Chandra Pandey, the learned counsel for the petitioner and perused the record.
2. Keeping in view the reliefs sought and the order proposed to be passed issuance of notice to the opposite parties is dispensed with.
3. By means of the instant petition filed under Article 227 of the Constitution of India a 93 years old petitioner has sought issuance of a direction to the learned Civil Judge, Junior Division Tanda, District Ambedkar Nagar to decide the Original Suit No.309 of 2024: Balikaran Vs. Ram Patti expeditiously.
4. A perusal of the order sheet reveals that the defendant had put in appearance before the learned trial court and pleadings have been exchanged.
5. It is a matter of common knowledge that the courts are overburdened with work and numerous old matters are pending, however, the fact that the petitioner is 93 years old is also a relevant factor to be taken into consideration for expeditious disposal of the suit.
6. In these circumstances, this court does not deem it appropriate to issue any direction itself to the trial court and the petition is disposed of with liberty open to the petitioner to move an appropriate application before the learned trial court itself which shall pass appropriate order thereon sympathetically keeping in view the advance stage of the petitioner.
